Building an Evidence Log Sheet

A listing describes a property; it does not in itself establish legal status. Create a log sheet with three columns: declared information, document received, item to be verified. Identify the person entrusting you with the property and their authority to represent it. For registered title land, the title certificate is a key check point, not a universal guarantee covering planning permission, physical condition, and permitted use.

The method in practice

Begin by identifying the legal status of the property: registered, in the process of registration, or unregistered. These situations do not allow for the same readings or conclusions. For a land title, note the reference, property description, titleholders and their shares, registered rights and encumbrances, as well as the date of the document. A mortgage and an easement answer different questions: the former may concern debt security, the latter a charge or right of use affecting the land. Do not translate "document received" as "secured file". Cross-reference the unit description, the available floor plan, and the property visited. A discrepancy becomes a written query, not an improvised correction on your part.

In Fez, a vendor advertises a private terrace. You note "use declared by vendor", then request the documents allowing a competent professional to verify it.

Never turn an unverified statement into an established fact.

Directing Every Query to the Appropriate Professional

A discrepancy in floor area, joint ownership, or building works alters the questions to be asked. The advisor collects necessary details and flags inconsistencies; they do not unilaterally settle legal issues. Coordinate checks with the notary and, depending on the matter, the land surveyor or competent authority. Log the query, the person responsible, the expected document, and an agreed follow-up date.

The method in practice

Build an index: document, issuer, date, property concerned, question covered, limitation, and recipient of the verification. A title certificate alone does not prove compliance of works or the authorization to operate tourist accommodation. If multiple titleholders appear, the power to sell cannot be inferred from the presence of a single contact person. In the case of a power of attorney, have the identity, scope, powers, required form, and validity verified by the professional handling the deed. Example: the listing describes a private terrace, whereas the document received does not allow for a conclusion. Your report maintains the declared usage and asks which document establishes the corresponding right. It does not rule on ownership.

The floor plan and the listing do not match: you amend the draft presentation, pause definitive claims, and request documented clarification.

Assigning verification responsibilities is far more useful than promising it will be straightforward.

Explaining the Transaction Journey

Present an educational timeline: project discovery, selection, verifications, offer negotiation, drafting contracts with qualified professionals, and handover follow-up. Detailed steps and conditions depend on the specific case file. Ensure interest rates, mortgage timelines, and legal clauses are confirmed directly by qualified professionals. An interest rate, bank timeline, or contract clause found online cannot bind a formal promise.

The method in practice

Turn checks into timeline dependencies: who examines registrations, who confirms powers, which document is a prerequisite for drafting, what feedback allows progress? For a mortgage, request the planned procedure and proof of release or discharge according to the file; the vendor's verbal promise does not resolve the matter. Distinguish between commercial agreement, preparation of the deed, and land registry formalities. Upon receipt of each document, archive the version and correct any affected presentations. The final deliverable includes a summary of facts, a list of open reservations, and precise questions addressed to the notary. Special ownership regimes, inheritances, and unregistered properties require dedicated analysis, without automatically applying the process of a registered property.

Before submitting an offer on a property in Agadir, you list outstanding documents and distinguish between an agreed commercial terms draft and formal steps to be confirmed.

Every commitment must have a sound basis and a named responsible party.

Fictional scenario: an apartment in Fez is presented as registered title, with a private terrace and recent renovation. The received file contains only photographs and an old listing sheet. Draft your response to the vendor.
